Report: Prosecutors Ask Judge To Begin Graham Spanier’s Jail Sentence

Pennsylvania prosecutors are reportedly requesting a judge to order former Penn State President Graham Spanier to begin a county jail sentence following the reinstatement of a child endangerment charge, according to the Associated Press.

The state’s attorney general’s office penned a letter to Judge John Boccabella Monday noting that “no legal impediment” prevents him from enforcing the 72-year-old’s two-month jail sentence and subsequent two-month house arrest.

According to the Associated Press, Sam Silver, Spanier’s defense attorney, asked Boccabella Friday to revise his sentence to house arrest with electronic monitoring. Silver wrote that Spanier had heart surgery in 2019 and is suffering from an “advanced stage” of prostate cancer.

“[Serving a jail sentence is] simply absurd and irresponsible right now,” Silver wrote in an email to the Associated Press.

Spanier’s conviction was reinstated in December by a three-judge panel on the U.S. Third Circuit Court of Appeals, which found a federal judge made a mistake in tossing out his conviction on grounds that Spanier’s due process rights were violated.

Spanier’s conviction on a child endangerment charge came in the wake of the Jerry Sandusky child sexual abuse scandal. He was initially charged in 2012 and later convicted in 2017.

Penn State forced Spanier out as university president in the scandal’s wake and was soon accused of a criminal cover-up, although many accounts were later thrown out. A jury acquitted him of all but one count of child endangerment.

Sandusky, meanwhile, was convicted on 45 counts related to child sexual abuse in June 2012. He’s currently serving a 30-to-60-year sentence in state prison.
