State College Police Condemn ‘Unlawful Assembly’ On Beaver Avenue Following Super Bowl LIX

State College Police Department Chief of Police John Gardner released a message to all Penn State students declaring the crowds on Beaver Avenue an “unlawful assembly” after the Philadelphia Eagles won Super Bowl LIX on Sunday night. The alert was sent at 10:40 p.m. and again at 10:51 p.m.

“I hearby declare this to be an unlawful assembly and in the name of the People of the Commonwealth of Pennsylvania, order all those assembled at Beaver Ave to immediately disperse, which means to break up this assembly,” the alert read.

Students and Eagles fans “flooded the Canyon” on Beaver Avenue to celebrate the Super Bowl victory and began to release fireworks, climb light poles, and block the roadway.

“If you do not [disperse], you may be arrested for violation of PA Crimes Code Title 18 sections 5507 A and b l i, the first being a misdemeanor 3 and the second being a summary offense being committed in our presence,” the alert continued. “Persons remaining in the area may also be subject to other police action including the use of kinetic energy projectiles and chemical agents, which include: tear gas, CN, CS, pepper balls, pepper spray or OC. Use of these devices could result in serious injury.”

Members of the State College Police Department were downtown ahead of the conclusion of Super Bowl LIX in anticipation of crowds, though Beaver Avenue was blocked in its entirety beginning near Allen Street and extending beyond Locust Lane.
