Former Penn State President Graham Spanier will serve at least two months in county jail after a judge upheld his sentence Wednesday, according to the Associated Press.

Spanier, 72, will report to the Centre County Correctional Facility on July 9 to serve at least two months, followed by two months of house arrest. The upheld sentence comes more than four years after he was convicted on a single misdemeanor count of child endangerment.

In January, prosecutors asked Judge John Boccabella to order Spanier to begin his sentence, writing that there was no legal barrier to enforcing it. Spanier’s defense had previously argued he wasn’t fit to serve jail time after undergoing heart surgery in 2019 and battling advanced prostate cancer.

Due to their client’s declining health, Spanier’s attorneys asked Boccabella to alter the sentence to house arrest with electronic monitoring.

Spanier was convicted in 2017 following his handling of a 2001 report about former Penn State football assistant coach Jerry Sandusky with a boy in a campus locker room shower. Although he didn’t testify at his trial, Spanier spoke at sentencing and said he regretted not intervening more forcefully.

A federal appeals court reinstated Spanier’s 2017 conviction last December.

Spanier was forced out as Penn State’s president in the wake of the Sandusky child sex abuse scandal back in November 2011. He was initially charged in 2012 for his handling of the report alongside former athletic director Tim Curley and Senior Vice President Gary Schultz, who both pleaded guilty to misdemeanor child endangerment charges in 2017 and also served short jail sentences.

Sandusky was resentenced on 45 counts of child sexual abuse in November 2019 to serve 30 to 60 years in state prison — the same sentence he originally received in 2012. Since then, he has maintained his innocence and made requests through his legal team for a new trial without success.
