Man Accused Of Breaking Into State College Apartment & Stealing Alcohol On State Patty’s Weekend

A West Chester man is facing charges filed by the State College Police for allegedly breaking into a State College Apartment and stealing alcohol, and assaulting medical personnel aboard an ambulance later that night. The ordeal took place during State Patty’s weekend.
The defendant, Manuel Deleon-Garcia, 22, is facing three felony charges along with four misdemeanors relating to the event.
According to the affidavit, a woman notified police that her apartment’s Ring Camera had gone off, showing an unidentified man entering the apartment without her (or any of the residents’) permission or knowledge. The resident, home at the time, commented that she noticed movement from beyond her bedroom door, as Deleon-Garcia was roaming the rooms.
A few minutes after the alarm, the video showed the then-unidentified male leaving with property stolen from the apartment. According to the affidavit, this was identified as an 8-pack of Lucky One Lemonade Vodka and a standard bottle of Tito’s Vodka, which comes to a loss of around $30.
Police did not give any information on how Deleon-Garcia managed to enter the apartment, but did ensure that none of the residents knew him or had given permission for entry.
At around 1:45 am (about an hour after the initial incident), patrolling police officers noticed a man lying unconscious on the sidewalk next to a bottle of Tito’s Vodka. The officer was able to wake the individual and noticed his breath smelled of alcohol, and his speech was slurred. When asked, the man denied having identification and gave a false name. The police then called EMS for a possible alcohol overdose, according to the affidavit.
The defendant tried to leave the scene and was eventually placed in the patrol vehicle until EMS arrived. The officers helped EMS transport the defendant to the ambulance, though he tried to break free, according to the affidavit. Once in the ambulance, the defendant became combative with the EMS providers, striking an EMT on the leg and a doctor multiple times in the abdomen and shoulder, according to the report.
At Mount Nittany Medical Center, the affidavit says that Deleon-Garcia resisted treatment from the staff by thrashing, which led to six security guards needing to hold him down before the nurses could begin to treat him. Medical records referred to in the affidavit state that Deleon-Garcia’s BAC was in excess of 0.40%, which is potentially fatal.
The officer from the break-in later noticed the second report, connecting the missing items and outfit of the defendant to the body-cam footage of the scene on the sidewalk. It was confirmed by SCPD officers that Deleon-Garcia was responsible for both events, according to the affidavit.
Deleon-Garcia was arraigned by Magisterial District Judge Don Hahn on the two sets of charges.
First, he is charged with felony counts of burglary and criminal breaking and entering, along with misdemeanor counts of loitering and prowling at night, theft, and receiving stolen property. For these charges, unsecured bail has been set at $42,500.
Second, Deleon-Garcia has been charged with a felony count of aggravated assault and misdemeanor counts of simple assault and public drunkenness. For those, unsecured bail has been set at $20,000.
A preliminary hearing is set for April 1.
