Penn State Football Wide Receiver Ben Whitver Intends To Plead Not Guilty In DUI Case

Penn State football wide receiver Ben Whitver intends to plead not guilty in his DUI case and has requested a jury trial, according to court documents.

Whitver faces two charges of driving under the influence of ethyl alcohol and Delta-9 THC. The 19-year-old freshman also faces a charge of driving the wrong way on E. Calder Way.

All three counts are from an incident on July 11.

According to the criminal complaint, when a State College Police officer pulled Whitver over, he detected a strong smell of marijuana and noticed bloodshot eyes.

The officer performed a field sobriety test — which Whitver allegedly performed “unsatisfactorily” on — before taking the Powhatan, Virginia, native to have his blood drawn at Mount Nittany Medical Center.

The lab result found a “BAC level of 0.020 gram% ethyl alcohol”, as well as a positive test for Delta-9 THC.

“We are aware of the charges against Ben Whitver. These alleged actions do not reflect the values and standards of our program and have been addressed pursuant to applicable Penn State policies and procedures,” Penn State football said in a statement to Onward State at the time of publication in August.

Whitver committed to Penn State minutes after the Nittany Lions beat Clemson in the Pinstripe Bowl. The freshman was originally committed to Bob Chesney and JMU, but decommitted when Chesney joined UCLA.

At the time of his commitment, 247Sports composite rankings listed Whitver as the No. 28 player in Virginia, No. 143 wide receiver, and No. 1,007 player nationally.

Whitver had not played for the Nittany Lions this season.
