Alumni-Elected Trustee Anthony Lubrano Wins Lawsuit Against Penn State
Penn State Board of Trustees alumni-elected member Anthony Lubrano won his lawsuit against the university last week. Lubrano sued the school for indemnification, meaning compensation of funds, as he defended himself against an investigation from the board and Penn State into his conduct as a trustee.
On September 30, Judge James A. Gibbons of Lackawanna County ruled Lubrano was entitled to the full amount of money he requested from the university. Gibbons also granted Lubrano’s petition for an injunction against the investigation and said Penn State must pause its investigation until it compensates Lubrano.
Lubrano’s saga with the university began in February, when he offered, and rescinded, a proposal to rename the field at Beaver Stadium, “Paterno Field at Beaver Stadium.” The board then punished Lubrano for his actions.
Lubrano said in his original court filing that he spoke about the board’s punishment in interviews afterward. The board later punished Lubrano for those comments and opened an investigation into his actions after other trustees made anonymous complaints.
Lubrano requested indemnification from the university in August, though his request was denied. The university offered Lubrano $10,000, though the trustee turned the money down.
The closing of Lubrano’s court case didn’t end Penn State’s legal battle. Fellow alumni-elected trustee Barry Fenchak is also suing Penn State to gain access to documents regarding university finances he feels are critical to performing his duties as a trustee. Fenchak was recommended for removal from his seat by the Board of Trustees Governance Committee in September.
